TERMS OF USE FOR THE ROYAL COLLEGE OF SURGEONS COSMETIC SURGERY CERTIFICATION ONLINE PORTAL

1. WHAT'S IN THESE TERMS?

These terms tell you the rules for using the Cosmetic Surgery Certification Portal certify.rcseng.ac.uk (which we call "our site").

2. WHO WE ARE AND HOW TO CONTACT US

2.1 'We' refers to the Royal College of Surgeons of England (RCS/RCS Eng/RCSEng) and related subsets and intercollegiate committees; The Faculty of Dental Surgery (FDS/FDS RCS/FDS RCSEng) and related subsets and intercollegiate committees; and, The Faculty of General Dental Practice (FGDP) and all related subsets and intercollegiate committees. 'We' also refers to the RCS in its capacity as a host responsible for the Joint Committee of Surgical Training (JCST) and all associated subsets of JCST; and, the Intercollegiate Committee for Basic Surgical Examinations (ICBSE) and all associated subsets of ICBSE.

2.2 www.certify.ac.uk is a site operated and maintained by The Royal College of Surgeons of England. We are a charity incorporated by Royal Charter under charity number 212808. Our main address is The Royal College of Surgeons of England, 35-43 Lincoln's Inn Fields, WC2A 3PE.

3. BY USING OUR SITE YOU ACCEPT THESE TERMS

3.1 These are the general terms of use by which you may make use of our site. As a registered user you will be forced to click that you accept these terms before being able to use our site after login.

3.2 In any event, by using our site, you confirm that you accept these terms of use and that you agree to comply with them.

3.3 If you do not agree to these terms, you must not use our site.

3.4 You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions see Section 4), and that they comply with them.

3.5 Application for Certification

3.5.1 You may apply for certification by:

(a) completing the relevant forms supplied by us and submitting an application to us through this Website;

(b) submitting such information in support of the application as may be prescribed by us; and

(c) paying the appropriate fee in the amount determined by us.

3.5.2 An application will only have been made once we have received the application form completed in full, together with all information required in support of the application and confirmation from you in the form of a declaration that the information contained within, or submitted in support of, the application is complete and accurate.

3.5.3 You are personally responsible for the contents of your application and any information submitted to us by you or on your behalf, and you must not submit (or cause or permit to be submitted on your behalf) information to us which you do not believe is complete and accurate.

3.5.4 In support of an application, you shall confirm which cosmetic surgery certificate, or certificates, you are applying for, together with any evidence required by us to demonstrate your suitability.

3.5.5 Before reaching a decision on the application, we may require from you such additional information, documents or references as it considers appropriate to the consideration of your application.

3.5.6 On receipt of an application, we shall appoint an evaluator to conduct a review of your evidence; and will decide whether to grant or refuse the application, and shall notify you accordingly.

3.6 Lapse of Certification and Recertification

3.6.1 If you are certified by us, then you must apply for recertification after you are next revalidated by the GMC.

3.6.2 You shall submit to us, in support of an application for recertification, evidence to demonstrate your recertification, which should consist of:

3.6.3 contributing to the collection of your outcome data in line with the Competition and Markets Authority requirements, and

3.6.4 contributing evidence about your cosmetic practice to your annual appraisal discussion as part of the requirement for whole practice appraisal (including relevant CPD activities about clinical and professional aspects of your practice).

3.6.5 We may require you to apply for recertification within a different period to that specified in section 3.6.1 where, providing reasons for our decision, we reasonably think appropriate for you to do so, in which case you shall apply for recertification within any different period that may be required by us under this Rule.

3.6.6 Failure to apply for recertification in the period set out in section 3.6.1 will result in the lapse of your certification.

4. THERE ARE OTHER TERMS THAT MAY APPLY TO YOU

5.1 We amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.

5.3 We may update and change our site from time to time to reflect new information.

6. WE MAY SUSPEND OR WITHDRAW OUR SITE

6.1 Our site is made available free of charge.

6.2 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted.

6.3 We may suspend or withdraw or restrict the availability of all or any part of our site for operational or other reasons.

6.4 We will try to give you reasonable notice of any suspension or withdrawal.

7. YOU MUST KEEP YOUR ACCOUNT DETAILS SAFE

7.1 It is possible to register on our site. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

7.2 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

7.3 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at certify@rcseng.ac.uk.

8. HOW YOU MAY USE MATERIAL ON OUR SITE

8.1 We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

8.2 The words:

8.2.1 "THE ROYAL COLLEGE OF SURGEONS OF ENGLAND"; and

8.2.2 our "Eagle" image:

are our UK registered trade marks. You are not permitted to use them without our written approval.

8.3 You may print off and may download extracts, of any page(s) from our site for your personal use

8.4 Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

8.5 You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

8.6 If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

11. RULES ABOUT LINKING TO OUR SITE

This information and these materials from other users have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

13. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

13.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

13.2 We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

13.3 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

(a) use of, or inability to use, our site; or

15. UPLOADING CONTENT TO OUR SITE

15.1 Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy

15.2 You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

15.3 Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our site a limited licence to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

15.4 We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy

16. WE ARE NOT RESPONSIBLE FOR VIRUSES AND YOU MUST NOT INTRODUCE THEM

16.1 We do not guarantee that our site will be secure or free from bugs or viruses.

16.2 You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.

16.3 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

17. WHICH COUNTRY'S LAWS APPLY TO ANY DISPUTES?

17.1 If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident outside of England you may also bring proceedings in your home jurisdiction.

17.2 If you are not a consumer, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England.
